Dress code violations are
easy to document
These records will be more credible if they
include written statements by any witnesses that are very specific
as to what occurred, dates and times of occurrences, and the
discipline rendered by the employer. Maintaining such records for
all previous cases in which discipline or employment termination was
necessary will provide evidence of consistent and credible policies.
The evidence of policy violations that is
required varies by the type of firing policy violation. For example,
a case of theft of physical property requires proof of exactly which
items were stolen and certainty of the person who committed the
theft.
Hopefully, for the sake of the employer, a
person or surveillance camera witnessed the theft, in which case a
sworn statement or film clip will provide the evidence. Evidence for
more sophisticated violations such as internet security breaches can
be provided by network and firewall access control software.
